OFFICIAL RULES The Showtime Free Preview Instant Win Game NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASING WILL NOT INCREASE YOUR ODDS OF WINNING.
1) Eligibility: The Showtime Free Preview Instant Win Game (the "Promotion") is open only to legal residents of the United States or the District of Columbia who are 18 years of age or older. The Promotion is void in Puerto Rico and where restricted or prohibited by law. Employees of Showtime Networks Inc. ("Sponsor") or its parent, subsidiary and other affiliated companies, company, subsidiaries, affiliates, prize suppliers, cable, satellite and other distributors, retailers, wholesalers, any entity engaged to work on Showtime programs, promotion partners, advertising and promotional agencies (the "Released Parties") and the immediate family (spouse, parents, children and siblings and their respective spouses) or household members of each are not eligible to enter. Entrants agree to be bound by the terms of these official rules. The laws of the United States govern this promotion. All federal, state, and local laws and regulations apply. 2) Entry Period: The Showtime Free Preview Instant Win Game begins at 12:01 AM Eastern Time (ET) on March 31, 2006 and ends at 3:00 AM (ET) on April 4, 2006 (the "Entry Period"). 3) How To Enter/Winner Selection: There are two ways to win prizes in the Showtime Free Preview Instant Win Game: 1) Instant Win Game: During the Entry Period, you can enter the Instant Win Game by calling 1-888-SHOWTIME. Callers will receive either a winning or non-winning recorded phone message. An instant win prize will be awarded to the first 100th caller and then every 100th caller thereafter during the Entry Period. If your call is selected as an Instant Winner, you will be required to speak slowly and clearly your full name, home address, home telephone number, and birth date in order for the judges to verify your prize claim status and fulfill your prize by mail. All Instant Win prize winners will be provided with a "prize claim code" which each is obligated to save if judges should require their prize claim code for prize validation purposes. LIMIT ONE CALL PER HOUSEHOLD PHONE NUMBER, PER 24-HOUR TIME PERIOD. Example: An entrant who calls at 8PM ET on Friday, March 31, 2006 cannot call again to play the Instant Win game until 8PM ET on Saturday, April 1, 2006. Any subsequent calls made by the same household phone number within the same 24-hour time period will be void; 2) Grand Prize Sweepstakes: There are three ways for eligible persons to enter the Grand Prize Sweepstakes during the Entry Period: a) Phone: Call 1-888-SHOWTIME during the Entry Period for a chance to automatically be entered into the sweepstakes when you order or upgrade to Showtime and provide your name, address, telephone number, and birth date. b) Phone: Call 1-888-SHOWTIME during the Entry Period and, if you are the 100th caller winner of an instant prize, you will automatically be entered into the sweepstakes one (1) time when you provide your name, address, telephone number, and birth date. c) Online: Go to sho.com/all4yousweeps during the Entry Period, complete the official entry form and click to submit. Limit one grand prize sweepstakes entry per person regardless of method of entry. While you can win multiple instant win prizes, doing so only enters you into the grand prize sweepstakes one time. Any subsequent sweepstakes entries by the same person will be void. Grand Prize Drawing: One random drawing to select a potential Grand Prize winner will be conducted from all eligible entries on or about April 11, 2006. Drawing will be conducted by Administrator, an independent judging organization whose decisions on all matters pertaining to the Sweepstakes are final. Potential Grand Prize Winner will be notified by telephone on or about April 11, 2006 at the telephone number provided at time of entry. Two attempts will be made to notify the potential Grand Prize Winner via telephone. In the event the potential Grand Prize Winner cannot be contacted after two attempts, the potential winner will be disqualified and an alternate winner will be selected. This process will continue until a potential Grand Prize Winner is contacted via telephone. Telephone calls will be made after 9:00 AM (ET) but no later than 5:15 PM (ET) each day until a winner is determined. The potential Grand Prize Winner is subject to the eligibility requirements set forth in Paragraph One above and compliance with these Official Rules. Potential Grand Prize Winner will be required to sign, have notarized and return to Administrator an affidavit of eligibility/release of liability, federal and state tax release, and where legal, a publicity release, within fourteen (14) days of issuance of notification. Failure to complete and return documents in the time noted, or if prize notification is returned as undeliverable, will result in the entrant being disqualified and an alternate winner will be selected and notified. 4) General: The Sponsor and any Internet access providers, telephone service providers or their parent, subsidiary and other affiliated companies, company, subsidiaries, affiliates, prize suppliers, cable, satellite and other distributors, retailers, wholesalers, any entity engaged to work on Showtime programs, promotion partners, advertising and promotional agencies are not responsible for incorrect or inaccurate transfer of entry information, human error, technical malfunctions, lost/delayed data transmissions, broadcast cancellation or pre-emption, omission, interruption, deletion, defect, line failures of any telephone network, cable TV/computer equipment, or software or any combination thereof, inability to access web sites or telephone service, damage to a user's computer system (hardware and software) due to participation in this promotion or any other problem or error that may occur, or for late, lost, incomplete, stolen, misdirected, mechanically reproduced, illegible, or inaudible entries. No responsibility is assumed for entrant information that is incomplete or incorrectly entered. Prizes may not be awarded to entrants who have provided unclear or incomplete contact information at time of entry or if contact information is unable to be transcribed. Participants who submit inaccurate entry data and/or exceed the entry limits may be excluded from participation at any time during the promotion. All entries become the property of the Sponsor. Any entry information collected from the Sweepstakes and Instant Win Game shall be used only in a manner consistent with the consent given by entrants at the time of entry, with these Official Rules, and with Sponsor's Online Privacy Policy that can be found at sho.com. Sponsor has contracted Marden-Kane, Inc. ("Administrator"), an independent third party sweepstakes administrator. The entry information is shared with Administrator for the sole purpose of the selection, notification, and the fulfillment of prizes. Entrants agree to be bound by these rules and consent to use of their names and/or photographs for advertising or publicity purposes by Sponsor and its designees in any and all media without further consideration, except where prohibited by law. Availability of the Showtime Free Preview programming during the Entry Period is subject to cable/satellite system (or other distributors) participation and scheduling changes. 5) Prizes: Instant Win Prizes. A $50 American Express Gift Card. For the purpose of calculating odds of winning an Instant Win Prize, it is estimated that 60,000 calls will be received during the Entry Period. Estimated odds of winning an Instant Win Prize are 1:600. Actual odds of winning an Instant Win prize are dependent upon the number of calls received during the Entry Period. Estimated Total Retail Value of Instant Win Prizes: $30,000. Gift cards will be delivered to winners within approximately 30 days of Promotion end date. If there is no 100th caller, no instant win prize will be awarded. Limit of four (4) Instant Win Game prizes per person. Awarding of prizes is subject to validation and eligibility verification. The data stored on the telephone computer systems of the Sponsor's telephone service vendor is the sole determinant of all Instant Win Prize calls. A potential Instant Prize winner may be required to provide Judges with the winning code provided at time of entry. Grand Prize: One (1) Grand Prize Winner will receive a silver 2006 BMW 650i convertible with black leather interior; 4.8 liter, V-8 engine with 360 hp. Estimated retail value of Grand Prize is: $80,000. The odds of winning the Grand Prize depend on the total number of eligible entries received. Accessories, options, and interior/exterior color may vary and are subject to change without notice. All options and upgrades on vehicle are sole responsibility of the Grand Prize Winner. Vehicle delivery must be taken from the BMW of Manhattan (New York) dealership location that has been designated by the Sponsor. If Prize Winner is located within 250 miles of the BMW of Manhattan dealership, Prize Winner will be responsible for picking up his/her vehicle and/or for any expenses related to shipping the vehicle to his/her residence. If Prize Winner is located beyond 250 miles of the BMW of Manhattan dealership, Showtime will (upon submission of valid expense receipt(s) by Prize Winner), provide Prize Winner with reimbursement for up to $2,000 in expenses related to shipping costs incurred for picking up vehicle at BMW of Manhattan and delivering the vehicle to his/her residence. Prize Winner is responsible for making shipping arrangements. Any shipping expenses in excess of $2,000 will be the Prize Winner's responsibility. All taxes, title, license, Department of Motor Vehicle fees, registration fees, insurance, any governmental fees required by Prize Winner's local jurisdictions (State and County) and any other expenses not explicitly specified herein are the sole responsibility of Prize Winner. Payment of certified funds for the above mentioned fees in the form of a wire transfer, money order, or certified check must be provided to BMW of Manhattan, along with proof of valid driver's license currently in force and satisfactory proof of automobile insurance, prior to vehicle's release. Prizes are non-transferable and no substitution or cash equivalent will be allowed, except at the sole discretion of the Sponsor who reserves the right to award prizes of comparable or greater value. All details of prizes not specified herein shall be determined solely by Sponsor. Any and all guarantees and warranties for prize is subject to the manufacturer's terms and conditions, and winner agrees to look solely to such manufacturer for any such warranty or guarantee claim. Warranty period is for four years or 50,000 miles, whichever occurs first, and begins on date of first retail sale, or the date the vehicle is placed in service as a demonstrator or company vehicle, whichever is earlier. Vehicle shown in advertising may not be actual vehicle awarded. Taxes are the sole responsibility of the winners. Estimated total retail value of all prizes is $110,000. 6) Limitations of Liability: Each participant agrees (i) to abide by the terms of these Official Rules and the decisions of the Sponsor and judges which are final and binding on all matters relating to this Promotion, and (ii) to release, discharge, indemnify and hold harmless the Released Parties from any and all claims or liability in connection with participation in this promotion or acceptance or use of any prize including, without limitation, any activity related thereto. 7) General Conditions: If for any reason this Promotion is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Promotion. Should this Promotion be terminated, Sponsor reserves the right to select potential winners in a random drawing from among all eligible, non-suspect entries received as of the time of the action necessitating such termination. Released Parties are not responsible for any problems or technical malfunction of any cable TV or telephone network, computer system, server, or service providers, cable TV/computer/telephone equipment, software, failure of any entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the telephone or digital cable TV network or any combination thereof, including any injury or damage to participant's or any other person's computer or telephone equipment relating to or resulting from participation in this Promotion. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE RELATED TO SPONSOR OR THE PROMOTION OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to who submitted an online or phone entry, the entry will be deemed submitted by the authorized account holder of the email address or telephone number submitted at the time of entry. "Authorized account holder" is defined as the person assigned to an email address or telephone number by an Internet access provider, online service provider, telephone service provider, or other organization responsible for assigning email addresses or telephone numbers for the domain associated with the email address or for the telephone number in question. 8) Winner's List: For the name of prize winners, available after April 30, 2006, send a stamped, self-addressed envelope to Showtime Free Preview Winners c/o Marden-Kane, Dept. KB, 36 Maple Place, Manhasset, NY 11030. Requests received after May 31, 2006 will not be honored. 9) Sponsor/Administrator: The Sponsor of this Promotion is Showtime Networks Inc., 1633 Broadway, New York, NY 10019 and the Administrator is Marden-Kane, Inc., 36 Maple Place, Manhasset, NY 11030.
