Inside the NFL - Ultimate Season Sweepstakes
OFFICIAL RULES NO PURCHASE NECESSARY A PURCHASE OR USE OF WIRELESS SERVICE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID IN PUERTO RICO AND WHERE PROHIBITED. Each text message sent to or received by a service subscriber of any wireless carrier will incur a standard text messaging charge in accordance with that carrier's Terms and Conditions applicable to such customer's particular voice/data rate plan. Contact your wireless carrier for text messaging plan details. 1) Eligibility: The Inside the NFL - Ultimate Season Sweepstakes (the "Sweepstakes") is open to legal residents of the 50 United States and the District of Columbia who are 21 years of age or older at time of entry. Employees, officers, directors (and their immediate families and those living in their same household) of Showtime Networks Inc. ("Sponsor"), Marden-Kane, Inc. ("Administrator"), and the National Football League ("NFL"), NFL Properties LLC, NFL Ventures, L.P., NFL Ventures, Inc., NFL Productions LLC, NFL Enterprises LLC, NFL International LLC, and its member professional football clubs (collectively, the "NFL Entities") and each of their respective parent companies, subsidiaries, and affiliates are not eligible to participate or win. Void in Puerto Rico and where prohibited. The Sweepstakes is subject to all applicable federal, state and local laws and regulations. 2) How to Enter: The Sweepstakes begins at 12:00 NOON Eastern Time (ET) on September 12, 2008 and ends at 11:59 AM ET on December 18, 2008 (the "Promotion Period"). Beginning on September 19, 2008, the Promotion Period will include fourteen (14) Weekly Drawings as defined in Rule #3. There are two ways to enter: 1) To enter online, go to ultimateseasonsweeps.com, follow the onscreen instructions, and complete the online entry registration process providing your first and last name, address, city, state, ZIP code, daytime phone number, and email address as directed. 2) To enter via Text Message: If you are a wireless service subscriber and have a text messaging-capable device, you may enter the Sweepstakes during the Promotion Period by texting any one of the promotional words provided on-air in TV broadcasts or in other sweepstakes advertising to the short code "74688". You will be charged for each text message sent or received from your handset according to the Terms and Conditions of your Service Agreement with your wireless carrier. Standard text and data rates may apply. Each wireless carrier's rate plan may vary, and entrants should contact their wireless carrier for information on text messaging rate plans and charges relating to your participation in this Sweepstakes. Any text message form of entry into this Sweepstakes will be deemed made by the named account holder whose mobile phone number is assigned at the time of entry to the text messaging device so used. Limit of one entry per person per week, regardless of method of entry. Entries will be placed into the Weekly Drawing for the week of submission and will be eligible for all subsequent Weekly Drawings thereafter and for the Grand Prize drawing. The Sponsor, Administrator, NFL Entities, and any Internet access providers, their respective parents, affiliates, divisions, and agencies and each of the foregoing entities' respective employees, officers, directors, shareholders, and agents (the "Released Parties") are not responsible for incorrect or inaccurate transfer of entry information, human error, technical malfunctions, lost/delayed data transmissions, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software or any combination thereof, inability to access web site or cell number, damage to a user's computer system (hardware and software) due to participation in this Sweepstakes or any other problem or error that may occur. No responsibility is assumed for entrant information that is incomplete or incorrectly entered. All entries become the property of the Sponsor. Any entry information collected from the Sweepstakes shall be used only in a manner consistent with the consent given by entrants at the time of entry, with these Official Rules, and with Sponsor's Online Privacy Policy which can be found at www.sho.com/site/util/privacy.do. Sponsor has contracted Marden-Kane, Inc., an independent third party sweepstakes administrator. The entry information is shared with Marden-Kane for the sole purpose of the selection, notification, and the fulfillment of prizes. Participants who submit inaccurate entry data and/or exceed the entry limits may be excluded from participation at any time during the promotion. Entrants agree to be bound by these rules and consent to use of their names and/or photographs for advertising and/or publicity purposes by Sponsor and its designees in any and all media without further consideration, except where prohibited by law. 3) Definition of Weekly and Grand Prize Drawing Cycles/Entry Periods: Weekly Drawings start at 12:00 NOON ET on September 12, 2008 and end at 11:59 AM on December 18, 2008. All subsequent Weekly Drawings begin at 12:00 NOON ET on the "Start" date and end at 11:59 AM (ET) on the "End" date shown in the Weekly Drawing Summary Chart below. All entries received between September 12, 2008 and December 18, 2008 will be eligible for the Weekly Drawing in which entry was received and will also rollover into all subsequent drawings, including the Grand Prize Drawing. The Sponsor is the official timekeeper for this sweepstakes. Weekly Drawing Summary: All start times are 12:00 Noon, ET; all end times are 11:59 AM ET
Grand Prize Drawing Summary
4) Weekly/Grand Prize Notifications. A random drawing to select one potential Weekly Prize winner for each 1-week cycle and one potential Grand Prize winner will be conducted from among all eligible entries received as outlined in the Weekly Drawing and Grand Prize Drawing Summary Charts that appear in Rule #3. Drawings will be conducted by Marden-Kane Inc., an independent judging organization whose decisions are final and binding on all matters relating to this Sweepstakes. Potential winners are subject to eligibility verification and compliance with these official rules. Marden-Kane will notify potential winners by regular mail, email or cell phone number (if text entry was selected) within seven (7) days of the respective Weekly or Grand Prize drawing. If contacted by telephone, potential winners who entered via text method will be required to provide mailing address information (e.g., full name, street address, city, state, and ZIP) in order to receive any necessary prize documents and/or to receive prize delivery. Potential Grand Prize winner will be required to sign, have notarized and return to Marden-Kane an affidavit of eligibility/release of liability, and, where legal, publicity release within fourteen (14) days of issuance of notification. Failure to complete and return the documents in the time noted or if prize notification is undeliverable for any reason will result in disqualification and an alternate winner(s) will be selected and notified. Grand Prize winner must be 21 years of age or older at time of entry. Each travel companion of Grand Prize winner must also be 21 years of age or older at time of travel (unless travel companion is the child of the Grand Prize winner) and must sign and return a consent to publicity (where legal), liability waiver, and travel release form prior to traveling. If travel companion is child of Grand Prize winner, Grand Prize winner must sign all requested documents on behalf of child. Acceptance of the prize constitutes permission for the Sponsor and its designees to use the winner and travel companion's names and likenesses for advertising and promotional purposes without additional compensation unless prohibited by law. Odds of winning a prize are subject to the total number of eligible entries received. 5) Prize: One (1) Grand Prize winner will receive two (2) tickets to one game of his/her choice for each of the sixteen (16) weeks of the 2009 NFL regular, domestic season schedule (for games that will be played within the continental U.S. only), a copy of which will be provided by Sponsor. Games played outside of the continental U.S. will not be available for selection by Grand Prize winner. If location of any selected game is greater than a 100 mile radius from winner's home, prize will also include round-trip coach air transportation for winner and guest to nearest major airport closest to the selected game destination from a single major U.S. gateway airport nearest to winner's home (as determined by Sponsor) and a 2 night standard double occupancy hotel stay at a Starwood Hotel (selected by Sponsor). Specific game tickets, air transportation, and hotel reservations are all subject to availability. If, for any reason, Grand Prize winner cannot take the trip on a date specified, the Sponsor shall have no further obligation to the Grand Prize winner other than to supply the remaining elements of the Grand Prize as described. All other expenses relating to acceptance of Grand Prize not explicitly stated herein, including but not limited to taxes, ground transfers, meals, beverages, alcoholic beverages, and gratuities are responsibility of Grand Prize winner and guest. Specifics of Grand Prize travel package are subject to availability and Sponsor's sole discretion. Complete terms and conditions of Grand Prize trip will be furnished with prize notification. Travel must be made through Sponsor's agent on a carrier of Sponsor's choice. Travel restrictions and blackout dates may apply. Winner and selected guest must travel on the same itinerary and are responsible for obtaining all required travel documents (e.g., acceptable photo ID). If Grand Prize winner resides within a 100 mile radius of any game destination selected, ground transportation may be provided (at Sponsor's discretion) for the Grand Prize winner and guest in lieu of air transportation and no compensation or substitution will be provided for difference in prize value. Prize is non-transferable. Any element of the Grand Prize (i.e. tickets, hotel, air), once awarded to the Grand Prize winner and to his/her respective guest(s), may not be transferred to any other party; no substitutions or cash awards allowed, except at the discretion of the Sponsor. Taxes are the responsibility of the winner. All details of prize not specified herein shall be determined solely by Sponsor. Any NFL event tickets awarded to the Grand Prize winner become responsibility of the winner upon possession of same and will not be replaced. The terms and conditions of the tickets awarded as a prize will govern in the event that any NFL sponsored game is unable to take place as planned, is cancelled or postponed, for any reason whatsoever, including an event of force majeure. Sponsor has no responsibility to the winner except to provide the trip(s) to designated location (if any), minus the game tickets and the trip(s) (if any) shall constitute full satisfaction of Sponsor's prize obligation to the Prize winner, and no other compensation will be awarded. Unused tickets cannot be refunded, exchanged, or applied towards tickets for any subsequent games. The Sponsor, NFL Entities, and/or any other relevant party reserve the right to remove or to deny entry to the winner and/or guest of winner who engages in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at any game. The Approximate Retail Value (ARV) of each pair of tickets is $200 and the ARV of air and hotel, if required, is $3,000/trip. The total ARV of the Grand Prize is $51,200. Actual value of prize may vary based on whether air travel and hotel are included for any games, winner's point of departure and arrival, dates of travel, and airfares at time of booking. Fourteen (14) Weekly Prizes: An "Inside the NFL" football, ARV of each Weekly Prize: $85 each. Approximate retail value of all prizes is $52,390. Any and all guarantees and warranties for merchandise prizes is subject to the manufacturer's terms and conditions, and each winner agrees to look solely to such manufacturer for any such warranty or guarantee claim. There is a limit of one prize per household. 6) Limitations of Liability: Each participant agrees (i) to abide by the terms of these Official Rules and the decisions of the Sponsors and judges which are final and binding on all matters relating to this Sweepstakes, and (ii) to release, discharge, indemnify and hold harmless the NFL Entities and the other Released Parties from any and all claims, actions, and/or liability for any injuries, loss or damage of any kind arising from or in connection with participation in and/or for entry into this Sweepstakes, any related activities, or acceptance or use of any prize won. 7) General Conditions: If for any reason this Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes. Should this Sweepstakes be terminated, Sponsor reserves the right to select potential winner(s) in a random drawing from among all eligible, non-suspect entries received as of the action requiring such termination. Released Parties are not responsible for any problems or technical malfunction of any computer system, server, or service providers, computer equipment, software, failure of any entry to be received by Sponsor on account of technical problems, human error or any combination thereof, including any injury or damage to participant's or any other person's computer equipment relating to or resulting from participation in this sweepstakes. In the event of a dispute as to who submitted an online entry, the entry will be deemed submitted by the authorized account holder of the email address submitted at the time of entry. "Authorized account holder" is defined as the person assigned to an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the email address in question. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. 8) Winners List: For the name of Prize winners, available after January 31, 2009, send a stamped, self-addressed envelope to Ultimate Season Sweeps Winners, c/o Marden-Kane, Dept. MB, 36 Maple Place, Manhasset, NY 11030.
